Privacy Policy of Cementerie Aldo Barbetti S.p.A.

Cementerie Aldo Barbetti S.p.A. with registered office in Corso Garibaldi 81, 06024 – Gubbio (PG), the Data Controller protects your personal data by ensuring confidentiality and compliance with applicable data protection laws, and by implementing appropriate safeguards to prevent unauthorized access or disclosure.

As required by article 13 of the General Data Protection Regulation (GDPR) of the European Union Cementerie Aldo Barbetti S.p.A. inform you that your personal data, collected through this website, is processed using electronic means for the purposes outlined below in this privacy notice.

1. TYPE OF PERSONAL DATA SUBJECT TO PROCESSING

The computer systems and software procedures used to operate this website acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols.

Consequently, the following personal data may be processed, by way of example:

  • Browsing Data: this category includes the IP addresses or domain names of the computers and devices used by users, the URI/URL (Uniform Resource Identifier/Locator) addresses, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response from the server (success, error, etc.), and other parameters related to the user’s operating system and computer environment. This data, necessary for the use of web services, is also processed to:
    • obtain statistical information on the use of services (most visited pages, number of visitors by time slot or day, geographical areas of origin, etc.);
    • monitor the correct functioning of the services offered.
  • Data communicated by the user: such as, for example, the personal data you provide through the forms on the site:
    • for the “contact” form: name, surname, email, telephone, reason for contact, any other personal data contained in the text message you send;
    • for the “apply now” form: name, surname, email, telephone, residence, educational qualifications, current job role, curriculum vitae data, including any image attached to the CV, health data if you belong to protected categories.

2. LEGAL GROUNDS FOR DATA PROCESSING

Your personal data will be processed for the following purposes:

  • to allow you to browse and use this website and to carry out the maintenance and technical assistance necessary for its proper functioning;
  • to allow the Data Controller to respond to your requests submitted through the “contact us” form on this website;
  • to manage your application through the “apply now” form for job searches and personnel selection for open positions within the company by collecting applications and related CVs and subsequently integrating you into the Data Controller’s organizational context through the establishment of an employment relationship, as well as any related legal obligations.

The law that allows us to process your data as described in point (a) is:

  • article 6 par.1 letter f) GDPR: “processing is necessary for the purposes of the legitimate interests pursued by the controller.”

The law that allows us to process your data as described in point (b) is:

  • article 6 par. 1 letter b) GDPR: The processing is necessary for the performance of a contract to which you are a party or in order to take steps at your request prior to entering into a contract.

The legal basis for processing of personal data as described in point C) in this document is:

for common personal data:

  • article 6 par. 1 letter b) GDPR “the processing is necessary for the performance of entering into a contract”;

for special categories of personal data:

  • article 9.2 letter b) GDPR “processing that is necessary for the purposes of carrying out obligations and exercising specific rights of the controller or of the data subject in the field of employment and social security and social protection law, only when authorized by the Union or member States or by a collective agreement, according to member state laws, and include appropriate safeguards protecting the fundamental rights and interests of the data subject”.

3. DATA PROCESSING METHODS

The personal data processed is collected directly by the Data Controller or by third parties expressly authorized by the same, or communicated by the Data Controller to such third parties for the purposes referred to in point no. 2.

Personal data will be processed primarily through IT tools by internal and external subjects of the Data Controller’s organization, duly authorized and trained according to methods and with means suitable to guarantee the security and confidentiality of the data itself, in accordance with the provisions of the GDPR.

The Data Controller periodically verifies that no personal data is processed, collected, archived or stored that is not necessary for the processing and related purposes as indicated in point no. 2 of this policy.

In carrying out the aforementioned activities, Cementerie Aldo Barbetti S.p.A. undertakes to:

  • ensure the accuracy and updating of the personal data processed, and promptly receive any corrections and/or additions requested by you;
  • notify you, within the time frames and in the cases provided for by current legislation, of any personal data breaches;
  • guarantee the conformity of the processing operations with the applicable legal provisions.

4. RECIPIENTS OF PERSONAL DATA

Personal data processed for the purposes set out in point no. 2 of this policy may be communicated to:

  • internal subjects of the Data Controller’s organization, duly authorized for the parts of the processing for which they are responsible;
  • external subjects acting as Data Processors on behalf of Cementerie Aldo Barbetti S.p.A., such as:
    • information and IT support companies;
    • infrastructure and IT solutions providers;
    • web service providers;
    • partner companies or otherwise connected to the Data Controller;
    • consultants, to the extent necessary to carry out their professional duties.

The communication concerns the categories of personal data whose transmission to the aforementioned third parties is necessary for the performance of the activities and for the purposes set out in this policy.

The updated list of Data Processors and Data Processors is kept at the Data Controller’s headquarters and is available upon request by e-mail to dpo@barbetti.it

For the processing and communication of your personal data described in this paragraph, your consent is not required as it takes place for the fulfilment of obligations arising from your request(s) and is covered by the legal bases referred to in point no. 2 of this document.

Your personal data may be communicated to public bodies, authorities and institutions that act as independent data controllers, in accordance with applicable laws or to fulfil binding provisions.

In no case will your personal data be communicated to other categories of third parties (in addition to those mentioned above) and will not be subject to disclosure.

5. DATA TRANSFERS OUTSIDE THE EU/EEA

The Data Controller does not transfer any of your personal data abroad (meaning all countries outside the European Economic Area).

The management and storage of your personal data will take place on servers of the Data Controller and/or of third-party companies duly appointed as Data Processors, located within the European Union.

Except for the transfers referred to in the previous paragraphs, some of your personal data deriving from the use of cookies and other tracking tools are shared with recipients who may be located outside the European Economic Area. Cementerie Aldo Barbetti S.p.A. guarantees that your Personal Data is processed by said recipients in accordance with applicable data protection laws. Said transfers may be based on an adequacy decision or on the standard contractual clauses approved by the European Commission. 6. DATA RETENTION PERIOD

Your personal data will be processed by the Data Controller for the time necessary to achieve the purposes for which they were collected as specified in point no. 2 of this policy.

In relation to the purpose referred to in point no. 2, letter a), browsing data is stored on the Data Controller’s systems for no more than seven (7) days (except in the case of the need to investigate crimes by the Judicial Authority which may result in an extension of the aforementioned terms).

With regard to the purpose referred to in point no. 2, letter b), your personal data will be processed and stored by the Data Controller for the time necessary to fulfil the requests for information and sending of communications made following your request and in any case for a period not exceeding thirty (30) days.

With regard to the purpose referred to in point no. 2, letter c), your personal data will be processed by the Data Controller for the entire duration of the selection procedure.

The Data Controller’s interest in retaining the personal data you have provided is reserved, for the time necessary to evaluate your candidacy for future open positions and in any case no more than two (2) years from receipt of the same.

Upon reaching the aforementioned terms, the Data Controller will proceed with the deletion of your data.

Longer retention periods may be applied in the presence of specific legal obligations or in the event that the Data Controller receives requests from public authorities or for further needs to protect the rights of the Data Controller or the Data Subject.

7. YOUR RIGHTS

Under EU Regulation 2016/679, you are entitled to:

  • receive confirmation of the processing of your personal data by the Controller;
  • access your personal data and learn its origin (when your personal data is not obtained directly from you), the purposes of the processing, the recipients to whom the data is disclosed, the data retention period or, failing that, the criteria used to determine it;
  • have your personal data corrected;
  • request the deletion of your personal data from the Controller’s databases when it is no longer necessary for the purposes for which it was collected or where the processing is unlawful and in other cases as provided for by Article 17 of the GDPR;
  • restrict processing of your personal data, for example, where you contest the accuracy of the data, for the period necessary for the controller to verify its accuracy, and in all other cases as set out in Article 18 of the GDPR;
  • obtain your personal data in an electronic format so that you can transmit it to another Controller (data portability).

The Controller shall address your request without undue delay and in any event within one month of receipt. This period may be extended by two months, in which case the Controller shall inform you within thirty days of the reasons for the extension.

8. COMPLAINTS

You have the right to lodge a complaint with the Data Protection Authority.

If you are resident in a different EU Member State or if the infringement of your data protection rights occurs in another EU country where the Controller is not established, you must lodge a complaint with the supervisory authority of that country.

Filing a complaint does not prevent you from pursuing other legal options.

9. CHANGES TO THIS PRIVACY POLICY

Cementerie Aldo Barbetti S.p.A. reserves the right to make changes to this Privacy Policy at any time notifying users on this website. Please consult this page frequently, referring to the last modified date indicated at the end of the document. Should you decide not to accept changes to our Privacy Policy the Data Controller may be required to erase your personal data. Unless otherwise specified, the previous Privacy Policy will continue to apply to personal data collected up to that point.
